We use SMS messaging solely for customer care purposes — consultation scheduling, project updates, and responses to your inquiries. We do not send promotional text messages. We retain personal information and project materials for as long as necessary to fulfill the purposes for which they were collected, to maintain business records, and to comply with legal obligations. Project files — including archival materials, footage, and the finished film — are retained for a period of no less than three years following project completion unless otherwise agreed in writing.

Part Two
WellTold Films (operated by Kith & Kin Films LLC, a Washington DC limited liability company) provides cinematic memorial and legacy documentary film production services for families, organizations, and partners. By engaging our services, you agree to these terms.
The specific scope, deliverables, timeline, and payment terms for your project will be set forth in a separate written production agreement, which governs in the event of any conflict with these general terms.
A deposit is required to begin production on any project. The amount and schedule of payments will be specified in your production agreement. All payments are processed securely through Stripe. Deposits are non-refundable except as specified in your production agreement.
Upon receipt of final payment, WellTold grants you a perpetual, non-exclusive license to use the finished film for personal, family, and non-commercial purposes. Kith & Kin Films LLC retains copyright in the finished film and underlying production materials unless otherwise agreed in writing.
You represent that any photographs, videos, music, or other materials you provide for use in your film are owned by you or that you have the right to authorize their use, and you grant WellTold a license to incorporate them into the finished film.
Unless you request otherwise in writing before production begins, WellTold reserves the right to use brief excerpts from your finished film for portfolio and promotional purposes, including on our website and in marketing materials. We will handle any such use with sensitivity and discretion, and will not identify individuals by name without consent.
WellTold will exercise professional care in the production of your film. In the event of equipment failure, unforeseen circumstances, or other events beyond our reasonable control, our liability is limited to the amount paid for services. We are not liable for indirect, incidental, or consequential damages.
These terms are governed by the laws of the District of Columbia, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts of the District of Columbia.
We may update these terms from time to time. The date at the top of this page reflects the most recent revision. Continued use of our website or services following any update constitutes acceptance of the revised terms.
